Liability Waiver & Release of Claims

 

By participating in a beach day experience with My Maui Beach Day, you acknowledge and agree to the following terms:

1. General Acknowledgment of Risk
   Participation in this excursion includes transportation by shuttle and time spent at a designated beach location. While we aim to provide a safe, enjoyable, and well-supervised environment, natural beach settings carry inherent risks that cannot be eliminated entirely.

2. Transportation
   By boarding the shuttle, you acknowledge that you are voluntarily traveling to and from the beach with My Maui Beach Day. While we take every precaution to ensure your safety, you understand that you assume all risks associated with transit and waive any claims related to injury, accident, or loss during transportation.

3. Beach Lounge Area
   Your experience includes access to a pre-set, hosted lounge area, including shade, chairs, towels, drinks, and snacks. Our team is available within this space to assist and ensure your comfort. This is the only area actively monitored by our staff.

4. Voluntary Departure from Lounge Area
   You are free to explore beyond the designated lounge area at your own discretion. However, once you leave the lounge space, My Maui Beach Day is no longer responsible or liable for any injury, accident, loss, or incident that may occur. This includes but is not limited to walking on surrounding terrain, swimming, or interacting with wildlife.

5. Limitation of Liability
   You understand and accept full responsibility for your actions and personal safety outside the hosted beach lounge area. My Maui Beach Day, its staff, partners, and affiliates are not liable for any incidents that occur beyond our designated and staffed zone.

6. Release of Claims
   By participating, you voluntarily release and discharge My Maui Beach Day from any and all liability, claims, or demands arising from participation in this experience, except in cases of gross negligence within the hosted lounge area.

By proceeding with your reservation or participating in the excursion, you affirm that you have read, understood, and agree to the terms above.
